5.11 Promotional codes are codes that enable customers to obtain benefits such as discounts, free delivery and free gifts. These codes are non-transferable so may only be used by the person to whom they are issued and must only be used in accordance with their terms and conditions of use. If you use a promotional code to claim a promotional benefit, you must first check that it was issued to you and that you are eligible to use it. By using it to claim a promotional benefit you will be confirming that:-
(i) you are entitled to use the code;
(ii) you meet all the conditions that apply to its use;
(iii) you agree to the terms set out below.
If, before accepting your order, we find that you are not entitled to use the code or do not meet all the terms and conditions of its use, we may reject your order or alternatively process it without the promotional benefit being applied. If, after accepting your order, we find that you were not entitled to use the code or did not meet all the terms and conditions of its use, we may reverse the benefit that you obtained. If you transacted on a cash basis e.g. by debit or credit card, we may take a further payment, equivalent to the value of the benefit obtained, from the card used. If you transacted on a credit basis, the value of the benefit obtained may be charged to your credit account.
5.12 Should you wish to cancel your order or return any goods, please go to the Returns section for further information. 5.13 The Ethos Group has attempted to show and describe items accurately using current printing technology
but slight variations in actual goods may occur. Images are shown for demonstration purposes only and
we do not accept any liability for changes in product design, colour, size, fragrance or specifications. Any
claim however arising will not exceed the price of the goods supplied to the buyer
6: Price
6.1 All prices are quoted in pounds Sterling and are inclusive of VAT unless otherwise specified.
6.2 Prices are subject to any changes to the rate or applicability of VAT
6.3 All item prices are exclusive of delivery and packaging, unless otherwise stated. Details of our delivery charges are found in our "Delivery" section.
6.4 Prices are correct at the time of order only and relate to internet purchases only. All orders for products are subject to availability and we reserve the right to refuse to supply any particular person.
6.5 We reserve the right to change prices without notice.
7: Payment
7.1 The Ethos Group charge your payment card when you process your order.
7.2 Payment must be made in pounds Sterling only by major credit or debit cards as listed: Visa, Delta, Master Card, Switch, Electron, Solo and American Express.
7.3 Whilst it is our intention to keep our website up to date and error free, product description or pricing errors may occur. If we discover such an error after you have submitted an order to us, we will contact you prior to accepting your order with the correct details. You may then either cancel your order or re-confirm it based on the correct information. If we are unable to contact you, we will treat your order as cancelled.
8: Passing of Property
8.1 We will retain the property in the products until full payment has been made by you and has been received by us.
9: Passing of Risk
9.1 The risk in the products will pass to you on delivery.
9.2 We shall not be responsible to you or any third party whether in contract, tort (including negligence) or otherwise for incidental, special, indirect or consequential loss or damage, any loss of profit (direct or indirect), loss of sales, loss of goodwill or reputation, loss of business, third party claims, pure economic loss arising out of or in connection of the performance or non performance of our obligations under these terms and conditions including such damage as may be reasonably foreseeable at the date you order the goods.
10: Delivery
10.1 Any date or period for delivery will be considered as indicative only, although it is our policy to try to fulfil standard delivery orders within 2 working day. Standard delivery orders containing items weighing more than 20 kilograms or to remote or rural addresses might take longer to deliver. We cannot be held responsible for delays in the delivery caused by our suppliers, or any other third party.
10.2 We cannot accept liability for out of pocket expenses or other costs incurred due to failed or delayed deliveries.
10.3 When we deliver your items to you may be asked to sign for the goods to acknowledge that you have received them. You should check for any damages before signing for them.
10.4 Claims for loss or damage to goods in transit cannot be accepted unless the company is advised within
48 hours of receipt of goods in the case of damage (damaged package must be kept for inspection
purposes). The company must be informed within 7 working days of date of invoice in case of loss. The
company will not entertain claims made outside the stated time limits.
10.5 All products are sent by courier or Royal Mail.
10.6 You bear the risk once the products have been signed for/delivered.
11: Acceptance
11.1 You will inspect products within a reasonable time after their receipt and you will be deemed to have accepted the products unless you notify us within 7 days of receipt that you want to cancel your order or you notify us within 7 days that the products are faulty. If no such action is taken, we will consider the products being as described, of satisfactory quality and fit for their purpose, and may not accept any rejection or cancellation at a later date. Your statutory customer rights are not affected.
12: Right to Cancel
12.1 You have the right to cancel your order providing that the item has not been dispatched, or has not been ordered from a third party company.
12.2 Exceptions to the right to cancel
i. Spray Tan Solutions can not be returned under any circumstances.
ii.Retail Items or Professional products are also exempt for return.
iii.Training, either one to one, group sessions or purchase of our manuals are non refundable.
iv. Equipment can only be cancelled 48 hours after ordering, providing the item has not been dispatched or ordered from a third party company.
v. Spray Tan Cubicles/Tents/Booths are excluded fully from our returns policy. Only one Tan Tent will be replaced per customer at any time if a fault is detected within three months. The metal frame work is not covered by any guarantee. Tan tents design, colour or features may vary slightly from the picture shown and no returns are accepted. All dimensions are correct at time of printing or web design.
12.3. All cancelled orders will be subject to a cancellation fee of 20% of the full price of the item being cancelled to cover the cost of administration and credit processing fees.
13: Faulty Items
13.1 Items faulty at the point of sale
Any item that was faulty at the point of sale may be returned for free repair, replacement or refund, provided you have the original receipt or alternative proof of purchase and the faulty item is returned complete with all components.
For items to be returned more than six months after the time of purchase the same above applies but in addition, evidence of fault at the time of sale will be required.
Please note that you will not be entitled to a repair, replacement or refund in respect of fair wear and tear. Please return the original and complete packaging.
13.2 Faults developed within the warranty period
Most items sold by The Ethos Group come with a 12 month manufacturer’s warranty. If a product develops a fault within the warranty period assistance will be provided by way of spares or a repair depending on the type of product purchased. Wear and tear is not covered by the manufacturer’s warranty.
Please note the following requirements relating to certain product categories:
Spray Tan Machines
All Spray Tan Machines are covered by a 12 month Manufacturers Warranty. The Warranty does not cover general wear and tear, miss use, using the item for other reasons that that for which it is intended, neglect or negligence to the item from poor maintenance or not using the machine as in accordance to the manufacturers guidelines.
Spray Tan Tents/Booth/Cubicle
The manufacturers warranty only covers the fabric from poor workmanship over the 12 months from date of purchase. The Warranty does not cover the metal framework. Tan tents that are damaged from your own neglect or from forcing the framework during dismantling.
14: Returns
14.1 When goods have been ordered in error or are not as expected the company may agree to their return
on the following conditions
i. A request must be made to The Ethos Group within 7 days of receiving the goods in writing via e-mail or letter.
ii. The products must be in their original conditions, unaltered or unused and sent back to us
with its original packaging. The customer must ensure the goods are adequately packed to avoid
damage in transit. Your statutory rights are not affected.
iii. Credit on account will be subject to the purchase price less a 20% handling charge and will only be
issued once the goods are received back at the company in first class condition. Carriage charges will
not be refunded. The credit will remain available for future purchases.
iv. Returned goods will only be accepted where a Returns Authorisation has been given prior to return
to the company. The relevant reference number must be quoted on accompanying documentation. For
your own protection, please obtain a receipt from the carrier, as the company accept no responsibility
for transport cost, lost or damaged parcels.
v. Spray Tan Tents/Booths/Cubicles Cannot be returned for a refund.
15: General
15.1 Please note that our products and promotions are only available in mainland United Kingdom and Northern Ireland* and, as such, may be unavailable in the region or country from which you are accessing the Site.
15.2 If any part or parts of these terms and conditions are deemed invalid, void or unenforceable, then that part or those parts will be considered severable from these terms and conditions thereby not preventing the remainder from being enforceable or effective.
15.3 These terms and conditions may be revised at any time and we reserve the right to do so. You are, therefore, advised to keep up to date with the contents of these terms and conditions as revisions are binding upon you.
15.4 Nothing in these terms and conditions will reduce your statutory rights relating to faulty or misdescribed goods. For further information about your statutory rights contact your local authority Trading Standards Department or Citizen's Advice Bureau.
16: Governing Law
Your use of this Site and any purchase by you on this Site of any products will be governed by English Law and will be deemed to have occurred in mainland United Kingdom.
17: Ordering goods for resale and professional use
17.1 The Ethos Group accepts all sales from the website on the understanding that the customer has all the relevant training and qualifications to use the products on a third party.
17.2 The Ethos group will not be held responsible for any problems arising from the use of our professional products on the general public, it is up to you the purchaser to hold adequate insurance and training for this profession or service.
17.3 Anyone found to be misusing our professional products that we hold a license to have all future orders declined.
17.4 Retail items purchased for resale must be advertised or sold at the recommended retails price on our website, however we will allow for small discounts, offers and incentives linked to the tanning business.
17.5 We strictly forbid any sales of our professional or retail products to third party resellers distributers or auction sites which include Ebay or similar.
